Terms of Service

1. Eligibility

You must be at least the age of majority in your jurisdiction (and at least 16 years old) to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Accounts

Some features require an account. You agree to provide accurate information and to keep your credentials confidential. You are responsible for activity under your account. Notify us promptly of any unauthorized use using the contact methods on our About page.

3. Description of the Services

WhosBest provides informational content, rankings, tools (such as the AI readiness checker), and community features. Rankings and scores are based on methodologies we publish or describe on the site and may change over time. The Services are provided for general information purposes and do not constitute professional, legal, financial, or technical advice.

4. Acceptable use

You agree not to:

• Violate applicable laws or third-party rights;
• Attempt to gain unauthorized access to the Services, other users’ accounts, or our systems;
• Interfere with or disrupt the Services (including by introducing malware, excessive automated traffic, or scraping that degrades performance);
• Use the Services to distribute spam, malware, or misleading or unlawful content;
• Misrepresent your identity or affiliation, or impersonate WhosBest or its partners;
• Reverse engineer, decompile, or attempt to extract source code or models except where applicable law prohibits this restriction.

We may investigate violations and cooperate with law enforcement. We may suspend or terminate access for conduct we believe violates these Terms or harms the Services or other users.

5. User content

Where the Services allow you to submit content (such as community lists, comments, or requests), you retain ownership of your content but grant WhosBest a non-exclusive, worldwide, royalty-free license to host, reproduce, modify, display, and distribute that content as needed to operate and promote the Services. You represent that you have the rights to grant this license and that your content does not violate law or third-party rights. We may remove content that violates these Terms or our policies, or that we are required to remove by law.

6. Intellectual property

The Services, including text, graphics, logos, software, and compilation of data, are owned by WhosBest or its licensors and are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from our materials without prior written consent. Limited quoting for non-commercial commentary or research, with attribution and a link to the source page, may be permitted where consistent with fair use or similar doctrines.

7. Third-party services and links

The Services may reference or link to third-party websites, tools, or data sources. We do not control and are not responsible for third-party content, products, or practices. Your use of third-party services is at your own risk and subject to their terms and policies.

We may integrate third-party tools on public pages when configured by us—for example, Google Analytics 4 for usage measurement and Google Search Console verification meta tags. Those providers’ terms (such as Google Analytics Terms) apply to their services.

8. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT RANKINGS OR SCORES WILL MEET YOUR EXPECTATIONS OR BUSINESS NEEDS.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHOSBEST AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100), IF YOU HAVE NOT PAID US. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

10. Indemnity

You agree to defend, indemnify, and hold harmless WhosBest and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your content, or your violation of these Terms or applicable law.

11. Dispute resolution

You agree to first contact us to try to resolve any dispute informally. If a dispute cannot be resolved informally, you and WhosBest agree that disputes will be resolved in the courts located in the jurisdiction we designate in our business records (or, if none is stated, the State of Delaware, USA), unless applicable law requires otherwise. You consent to personal jurisdiction in those courts. If you are a consumer in a jurisdiction that gives you the right to bring claims in your local courts, that right remains unaffected where required by law.

Class action waiver. To the extent permitted by law, disputes must be brought on an individual basis only, not as a plaintiff or class member in any class or representative proceeding.

12. Changes

We may modify these Terms at any time. We will post the updated Terms on this page and update the “Last updated” date. Material changes may be communicated through the Services or by email where appropriate. Continued use after changes become effective constitutes acceptance of the revised Terms.

13. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Services (with notice where practicable). Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and dispute resolution) will survive termination.

14. General

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WhosBest regarding the Services and supersede prior agreements on the subject. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
